    Default Are Youtube Author Liable for Viewer's Injury

    My question involves a consumer law issue in the State of: WA

    There are alot of instructional videos on youtube. There are even prank videos teaching things that don't work (e.g. speed up internet for free)
    If a viewer suffers an injury (or humiliation) trying to learn from a video, is the author liable?

    And if a random person makes a suggestion in the comment section of a video, and another person followed the suggestion and got injured, is the random person making the suggestion liable?

    Generally the answer is no. Those random people have no duty to you and, moreover, it's up to you whether to try the stunt they suggest. You should have a pretty good idea most of the time what risks there are when doing something stupid that someone else says you ought to try.

    Humiliation isn't generally compensable (except in connection with physical injury). Beyond that, whether liability might exist depends on all of the specific facts and circumstances. However, even if liability is theoretically possible, collecting from some ass-clown who posts stuff on YouTube isn't going to be very likely.

    In order to establish a "Causation" nexus between any possible forseeability or negligence/duty claim, as others have stated, very specific facts have to exist.

    It is presumed a person will obey the criminal laws and conduct themselves in a nontortious manner, therefore assigning original actions of one to a third party is a very very broad legal conclusion.
