    Default Can Federal Govt Levy Charges on This Person

    My question involves criminal law for the state of: CA

    Here in Fremont, this gentlemen, a career criminal with a rap sheet was arrested in late December...again:

    He is currently being held, I think in Santa Rita Jail

    Case # 20-CR-000057



    My question is, Can the Federal govt jump in and also levy charges on him for having a gun (prior felon)?

    If so, how we can call attention to the US attorney (I'm assuming its SF US Attorney) to get involved?

    I remember in that high profile Kate Steinle trial, the illegal alien person was charged with federal possession of fire arm.

    Call him up, write a letter, post on his website, etc. Then it's up to him to decide if he wants to get involved.

    The feds do not typically intervene in matters that are also criminal for the state. Unless this man's activities crossed into the realm of civil rights violations,committing crimes across state lines, or something equally within the purview of the feds, I doubt they will get involved. In my experience it is like pulling teeth to get the feds involved in cases for which there are clearly state laws violated as well. You can inquire as suggested, but do not expect anything to come of it.

    It appears he is now facing multiple felonies including felony resisting and evading charges. <sarcasm> But, given that this IS California,and the Bay Area, maybe they'll throw the book at him and he'll get house arrest for 6 months.</sarcasm>
