    Default Seeking Expert to Opine for Plaintiff on Standard of Care and Causation-Seattle Area

    My question involves malpractice in the state of: Washington

    Hello. I am seeking a candidate, or recommendation of same, to generate an expert opinion in a legal malpractice case for Plaintiffs, opining on the Standard of Care and Causation.

    This is not the place to seek an expert. Your attorney should be able to recommend one or more experts.

    We are pro se at this stage, having not let the case to a firm yet. We've called dozens of malpractice firms, with no progress in locating an expert.

    If this is not the place to seek an expert; might you direct me to the proper venue?

    Any suggestions on a process to locate one?

    Let me make this observation: litigating a legal malpractice case pro se is a very difficult thing to do. Depending on the details of the type of malpractice involved, you may have to prove not only negligence of the attorney but also that you would have won your claim but for that negligence. Thus it is often said that many legal malpractice cases involve trying two issues: the legal malpractice claim and the case that the lawyer was to represent you in.

    And if you are going to get a lawyer to represent you, then you are wasting your time looking for an expert yourself. Your attorney will have experts that he or she will want to use for your case.

    We are certainly not choosing to proceed pro se.

    Because our action is a malpractice within a malpractice case, and despite prima facie evidence establishing both claims, it is difficult to fight the stigma assumed by potential representation. Despite nearly $10M in established damages (uncontested financial damage expert evaluation in hand), and unimaginably unethical behavior on the two Defendant lawyers, Plaintiff's candidate attorneys are not even interested in reviewing the case. We anticipate that obtaining our legal malpractice expert opinion will make representation retention easier.

    Certainly, once a malpractice expert is located, we will have no difficulty obtaining the requisite opinion:
    The expert opinion from the first malpractice case commented that this was the most egregious case of malpractice he had ever seen, including multiple instances of perjury within documents and before the court, filing of falsified and fraudulent court documents attested to under oath, and generation of a fictitious and unsigned (by Plaintiffs) damage claim on the eve of SJ for lack of production...simply because the attorneys failed to proffer readily available evidence. Then, in an act of sheer panic, they repeatedly perjured themselves before the court to justify their withdrawal, without cause, 30 days prior to trial...after "representing" the action for over 6 years.

    The second attorney, hired to pursue the first, did absolutely nothing but bill until, ultimately, after ignoring the direction of the court, and never producing a damage claim (despite multiple expert opinions in hand) he failed to establish causation...despite the prima facie evidence in hand, and ultimately lost on that issue at SJ. He then, despite our efforts to collect the case file covering the underlying case, and including the expert opinions, destroyed the case file to circumvent our recovery.

    The willingness of humans to jump to unwarranted conclusions is our principle obstacle. To quote Clint Eastwood: "It is dangerous to draw conclusions without the facts!" (emphasis added to imitate Clint

    ummmm....thanks??? hehe We have looked there ad infinitum.

    We've called dozens of legal malpractice firms, and without even scaring them off with the whole malpractice within malpractice, we can not find an expert. It would seem that there would be individuals making a career out of offering expert opinions...which is why it surprises us that they are so difficult to locate.

    We are not even looking for an expert to opine on the entire fiasco. We simply need an expert opinion on the malpractice of the most recent attorney, since we already have the expert opinion on the behavior of the previous attorneys.

    Doesn't every single malpractice attorney have to produce an expert opinion to advance their case?
