My question involves real estate located in the State of: Delaware
My neighbor's property borders my driveway and they have placed large rocks within a few inches of the edge. Every time someone enters my driveway we run the risk of our car sustaining damage. I have hit them as well as any friends and family who dare to enter. When they get hit, the rocks shift a little and soon after the owner moves them back. He's even put a piece of rebar in the ground to prevent them moving. I have asked them to remove the rocks and replace with something flat (to prevent tires running over the corner of grass) and they ignored me. Is there a law about encroachment or creating a hazardous condition? Friends whose car sustained damage have threatened to sue. What can be done?
