    Default Levy on Account for Unknown Reason

    My question involves court procedures for the state of: FL, MA interstate.

    Saturday we made a deposit to our bank account. Once the deposit had been made we noted the balance to be significantly less than it should have been. We questioned the teller, then had to meet with another bank rep. The 'meeting' uncovered two recent debits on our account due to a 'levy', also a third debit for a 'levy fee' assigned by the bank. I should note the two debits for the levy were in the exact same amount, one made on the 25th, and again on the 30th. We have no debt. We have no judgements against us. We have had no correspondence with any entity about any such issue. The only help our bank could offer was a phone number which turns out to be to a law practice in Boston, MA. We are in FL. We have never been to MA. We do not do any business in MA. Our account has been apparently legally robbed of almost half a million dollars.
    How does a law firm we've never heard of get access to our bank account?
    How does a legal process we have no knowledge of target us without our knowing?
    Why isn't our bank, who stands to lose a very big customer now, doing anything to assist us? They wouldn't even put a freeze on our account at our request to protect the funds still in the account.

    How do we get this resolved?

    1. Get the bank to give you a copy of the levy/garnishment order that it claims it acted upon in taking out the money.
    2. Look up the judgment that is the basis of the levy and get a copy of that.
    3. Talk to the lawyers that obtained the judgment to clear up any problems with the judgment, like the judgment being against someone else or whatever, and get them to return the funds to you if they were taken in error.

    I suggest that you first call the phone number they gave you and see what the attorney's office has to say about the levy's. Perhaps this is just a mistake.

    If you never got served with a judgment from any lawsuit, and you can't resolve it with the attorney, then run this buy a local attorney to recover your money.

    Thanks, we plan on starting that first thing Monday morning. We've attempted to call the law office multiple times since being given the number on Saturday, with no response. So we can insist the bank give us a copy of the order?

    Thanks, we did try calling the law firm without response, will try again Monday morning. No, there's never been any notice of anything, first inkling was finding our account had been robbed. Literally, it feels like a robbery.

    Hmm . . supposedly you had sitting in a depository bank account more than a half a million simoleons of which you have mysteriously been "robbed" and must resort to seeking legal solutions from the unknown and anonymous?!

    Normally people that have acquired such wealth would at least have on hand the name of an attorney (if not one on retainer) who might not object to taking calls after hours or on weekends.

    I'm at a loss to understand the purpose of these question. We have no information about your situation beyond what you told us.

    If I were in your position, I'd be meeting with the bank manager and demanding all documentation supporting the levies. I'd also immediately open a new account at another bank and move all of my remaining money. Failing immediate resolution, I'd hire an attorney.

    Thank you budwad, your advice and information was the most useful. The situation has been resolved, and getting to speak with the law office once they opened this morning was helpful, also gong to the bank once they opened as Taxing Matters suggested and getting a copy of the levy order was also very helpful. To make a long story short this has been a compounded comedy of errors, initially a wrong account number used in a billing company system placed funds in a wrong account that sat there never recovered, once they discovered their mistake they sent emails to an office manager who ignored them, ignored letters, ignored certified letters and the initial company got a judgement to recover the money they placed in an incorrect account - that never showed in our account either. Supposedly since they claimed the monies were an error and in our account (long story, there is a clearing house account that eventually dumps into our account, the monies in question were still sitting in the clearing house account all this time ) and the account levied against was the eventual destination of funds from the clearing house account, they levied the destination account. What. A. Mess.

    Thanks again for being helpful advice givers on a weekend when no one was able to give guidance.

    You seem nice.

    Nothing was 'supposed'. Sometimes people who do acquire 'such wealth' have the incentive to use tools - such as the internet - to try to figure things out based on research.
