Hello again. On today's payroll we discovered that two employees were improperly paid for their overtime (paid based on the 80 hour pay period and not the 40 hour work week). I asked one of them to go back and pull pay stubs from several months ago that should also have had overtime pay on it, and it wasn't there.
I believe this to be a willful violation. Am I allowed to report this to the DOL or do they have to do it themselves? Do I give them the chance to correct it before reporting the violation? What does correction look like? How quickly are they required to correct the current paycheck? They said that they will pay it out on the next payroll.
