    Default Job Interview With Dismissed Larceny Charge Still On Record

    Hello everyone,

    Everything is pretty much in the title except my state (which is North Carolina). Iam 19 years of age now but when I was 17 I stoled $114 worth of video games, I hired a lawyer who got me into the First Offenders programs. Completed this program and the charge was dismissed. After my last court appearance I remember signing expungement papers , however, recently I called my lawyer's office and his clerk said my charge is still on file but as dismissed.. My job interview is tomorrow.. -sighs- what are my chances? slim to none?.. I figured no employer wants to hire someone who have shoplifted in their past.Should I explain to the employer what happened if they ask? I am going to be honest and straight forward. Its so depressing. I've been working to work at this place for years, and now the opportunity is here! but this charge is preventing me.

    If your crime was at 17 that makes you a minor those records are normally sealed once you reach 18. If your record reads "dismissed" then that is hardly a conviction in fact the average reader would assume you were found not guilty or charges dropped

    North Carolina treats 16- and 17-year-old offenders as adults.

    Default Help! Job Interview Part 2!!!

    This morning I went to the north carolina court house for a background check. They said my charge had been expunged.. HOWEVER, when i go for the job position the private database they use for their background checks may pick up on my charge dismissed charge since it was expunged recently...!!!!...In other words, even if my charge was expunged..it can still haunt me?!?! ..does this makes since to anyone?!

    Yes. There's typically a lag between when a public record is updated and when a private company, which includes that record in its own private database, may update that separate data.

    You have to realize that it is hard for thieves to get jobs.

    Are you sure the employer runs background checks?

    If asked, I personally would be honest, including noting that the offense had been expunged and expressing sincere regret over the incident.

    If asked, definitely don't lie. Some people are not hired for jobs due to something picked up on a background ck. that they lied about where as if they had admitted to it, they would have been hired.
