    Default Moving to Another State on Probation

    My question involves criminal law for the state of: California. I'm seriously considering moving out-of-state to finish college, but I'm on two years summary probation for a hit-and-run accident last year (I had a separate thread in the Traffic Law section on that.) My probation terms were just stay out of trouble, but if I'm on unsupervised probation, can I leave the state for any length of time or reason? I guess it wouldn't hurt to ask the court about it.

    And also, if I want to get this dismissed, what is the best (or least-worst) option to do so?
    1: Start it as soon as tomorrow
    2: Go for it after a year on probation goes by (which will be in December for me)
    3: Just wait the two years out.

    CA summary (aka "court") probation rarely has a condition that mandates you stay within the state. Your best bet might be to contact the Probation Department to make sure.

    As for getting your probation "dismissed", you'll have to look into that with the Probation Department. I don't recall hearing of it happening in less than one year, but, it can't hurt to ask.

    Yes, unlike other states, California seems to only restrict felony probations. In any event, if you have the restriction, probation transfers when you are in good standing and have reasonable cause to make the move are pretty routine. Your PO will send your info to the probation office where you want to move. They'll agree and specify if they have any conditions. It goes back to your PO and they'll approve the move. It can take a month or two to get all the paperwork lined up.
