Child with Someone Who's on a Visitor's Visa

My question involves a child custody case from the State of: Arizona

My girlfriend who is originally from Guyana is staying with me here in Arizona. She is here on a B1/B2 Visitor Visa and only has 4 months left she can stay in the country lawfully.

She is about 4-5 weeks pregnant. I don't want to raise a child, and I am not capable of raising a child at the moment. My first thought would be adoption, but I don't know if she will do that.

Can she use this baby to try and get permanent residence? Can she collect child support from me here in Arizona?

Well, she can try to get permanent residence, it's not likely to work just because of the so-called "anchor baby." The immigration laws do not work that way. She doesn't get preferred status even if her child is born here.


The answer to the second, regarding child support, is not only yes, but HELL YES. If she applies for it, she will get it whether she's here legally or not. Even if she doesn't apply for it, but ends up getting services for the child, the state will likely come after you.

I see nowhere in the posts that says that the child is OP's. Only that she is 4-5 weeks pregnant. So OP, is this your child and how do you know that?

Doesn't change my answer. The only difference is whether HE is the one that she or the state will attempt to recover from. But I think the thread subject line implies that it is his. When you say you have "child with someone" that generally means that.

This would be a rather pointless post if you did not believe this child to be yours. That begs the question why, if you "don't want to raise a child" and believe your self "not capable of raising a child," you chose to impregnate a woman.

Yes.

Once the child is born, she can seek to establish your paternity and, if you are proven to be the father, to obtain an order that you pay child support.
