    Default Damage to Neighbors

    My question involves landlord-tenant law in the State of: Michigan
    I work for a property development company and builder and am assigned some things I am not quite sure of on how to handle. I could ask my boss further what to do, but she is a tyrant to say the least and said to "figure it out myself and research" after saying its her problem. Hence, why I'm here. I am asking another question about my boss in another post under discrimination. We had a call come in today from a women who lives next door to a rental of ours, that stated our tree broke her car window and she wants the money back she spent to fix it. I asked if she owned the home, she said yes. I said you need to call your insurance. She said the insurance agency stated that we need to pay for it and she called the police. On top of that, if this girl decides to sue, I am certain my boss wants ME to go to court because she is having me sign leases and handle those. Is that even legal for me to go to court and represent? Doesn't that mean then I will be sued if things falter on my place of work?

    You can't represent the company in court because you are not a lawyer.

    What you should be doing is calling your insurance company.

    Who do you think would sue you?

    I asked my boss that she got mad at me and said it isnt our insurance problem its her insurance companies problem. I was concerned the girl would sue me if I was the one representing the company in court and ok good to know!!!

    Then your only response to the neighbor is that it isn't your company's problem. And it certainly would never be YOUR responsibility.

    BTW... If your company gets sued and your boss wants you to represent the company head back here and let us know. I'm sure we could find the law that says you can't.

    If the tree branch was overhanging her property and it fell and broke her windshield, it is her problem and not yours if it was an act of nature. She has to work it out with her insurer.

    Your boss did not mean to represent the company as legal council. If you can sign leases. you would more than likely be the one to appear in court representing the company. It sounds like you have power of attorney to represent the company in certain areas. You would not be sued personally.
