    Exclamation What Do Child Support Payments Include?

    Hi,

    I am from ohio and I have a question:

    Back in December, I had a child. The father has yet to help me with this child. A paternity test has been conducted and established, and I have a hearing set for next week.

    My question is, will I get a lump sum for the five months that he has not paid to me? If not, then do they make him make arrangements for making additional payments for what is owed?

    I just don't think that it is fair that he should not have to pay, this was a planned pregnancy. But we broke up before our daughter was born and now he acts like a total deadbeat. I have had to pay for everything from crib to clothing, diapers, etc...

    This is our second court date, the first one was rescheduled because I "conicidentally" got a flat tire on the day of our first appearance.

    He's seen her one time, and that was to ask me if he could claim her on his taxes...I've had all I can take of BS!

    It is highly unlikely that you will get a lump sum if retroactive support is ordered unless he has been saving up money and decides to give it to you that way. The judge will probably just tack on an additional amount to what the current child support would be ordered as.

    You do not have to allow him to claim her on his taxes this year as you have had custody of her since birth. Some judges do order that you claim the child on alternating years, but for the most part you will get to claim her if you have custody of her for more than 51% of the year.

    Side note: He is not a deadbeat until there is a court order for support and he does not pay it.

    If Ohio law is like Texas law, then you probably will receive child support retroactive to birth, payable as an additional amount each month tacked on to whatever child support you begin to receive once there is an order. Here in Texas, you would also probably be reimbursed for half the uninsured prenatal and delivery expenses.

    I disagree with Neal1421 - just because there's no legal obligation to support his child - yet - does not mean the dad is not under a moral obligation to help support the child. In that sense, he is a deadbeat dad.

    However, this is a legal website and therefore legally he is not a deadbeat. If paternity was just legally established, he legally was not the child's father and therefore was under no legal obligation to pay support.

    Moral is completely different than legal. Since you want to view the moral side of a situation, let me pose this question to you:

    Did you know that when a father pays ANYTHING toward his child's care BEFORE a court orders him to, the laws do NOT require that the father be given any credit for those payments? The law considers the monies to be "gifts", and a court can legally (and often does) order retro CS be paid, forcing a father to PAY TWICE?

    How moral is that?

    Hello again!

    I would like to thank you guys for reply so quickly to my post. I really do appreciate it! I for sure plan to ask for retroactive support on Monday, it's time for him to step up to the plate--even if he chooses to never see my daughter again.

    This fall, I will have completed my degree in Paralegal studies, and it won't be long before I'll have a new career, more income and his too.
