I'm curious as to what the legal threshold is for information to be confidential? Our company has confidentiality/non-disclosure agreement that all employees must sign. The language basically says that anything that isn't publicly available can't be shared. the company is always pitching to potential investors and never requires a potential investor to sign an NDA unless they are going into deeper diligence. The pitchbook that is presented to investors includes a ton of information that management tells employees they can't discuss any of it if they leave as it is under the confidentially agreements they signed.
If the information is shared openly with potential investors not under an NDA, can is still be considered confidential? It has probably been presented well over 100+ times.
