Default Floor Noises from Above in a Newly Constructed Condo

My question involves real estate located in the State of: California

Thanks for any help in advance. I am one of the first time home buyers in the bay area, I put my little savings towards a newly constructed condo. A week after I moved in looks like my neighbor upstairs also moved in to the same building. I started noticing booming floor noises everytime he walks around, my couch vibrates a little whenever this happens. I was told by the sales and assured by the builder that floors in this 4 storied building would be insulated. I trusted them now I notice this. Having lived in the apartments for 10 years I am used to some noises but not vibrations and booming noises like this. This feels like a mild earthquake sometimes. I am sure my neighbor isn't stomping around, he is new to this building as well.

What options do I have? How do I go about resolving this if HOA or upstairs owner doesn't care (since he is on the to most floor). My house is still under warranty is what my builder says, how can I leverage this to solve my issue. Any help/information regarding this would be of great help.

    Thanks a lot again,
    S

"I was told" and "I trusted." Two of the most dangerous phrases in the English language.

    Carefully read your warranty.

I doubt that a noisy neighbor is covered.

I have no answers for you other than to take your contract and warranty to an attorney.

Have you considered going up to his condo and talking to him?
