My question involves criminal law for the state of: New York

A friend had a serious frontal lobe injury in an auto accident several years ago. The brain had a laceration and hemorrhages in the frontal lobe requiring multiple operations. He has been receiving treatment continuously , and progressed to the point of having a consistent job, and returned to college, recently getting A’s. Unfortunately, drug abuse has been a problem.

Frontal lobe damage is known to cause disinhibition, impulsiveness and inability to control behaviors. He has been arrested in the past for drug possession. On parole, he was arrested with ketamine. Ketamine is used to treat PTSD, and his psychiatrist had actually mentioned prescribing it. He may have been trying it illegally and found it helped. But, it looks like they are considering him to not care about the law, and ignoring his probation.

He is at serious risk of being sent to prison. Incidentally, a report to Congress by the CDC said that people incarcerated for drug abuse who have brain injuries are actually at greater risk for returning to drug abuse than those incarcerated.
