    Default Should I Rent My Property with a Swingset in the Backyard

    My question involves landlord-tenant law in the State of: NewYork

    I a new landlord and looking to rent my entire house however i also have a swingset in my backyard.. is it ok to rent the property with the swing set and have the tenant sign a wavier? will this infact release me from all liabilities?

    No waiver is good enough to "release you from all liabilities."

    I assume if you are renting the property that you have liability insurance? Make sure you have enough insurance to protect you and go on with your life.

    Get an umbrella liability policy. They don't cost much to get a million dollars worth of coverage. The swing set will be a big seller (assuming its in good condition) with anyone with children or grandchildren.

    What does "is it ok" mean? It's ok with me. If you're asking whether it's legal, the answer is yes unless the locality where the house is has some very bizarre laws about rental property.

    No waiver -- no matter how well-drafted -- will protect you against "all liabilities." The likelihood that you would have any liability to anyone because of a swingset on rental property is incredibly slim, but the way to protect against that possibility is to purchase appropriate insurance (i.e., a landlord's policy).

    I'm a retired claim rep and a former landlord.

    My advice: Get it out of there.

    The first time a kid gets hurt, it'll be your fault (according to the tenant).

    The first time it gets broken, they'll want you to fix it like right now.

    It's best not to give tenants any extras.

    Two more bits of advice:

    1 - Study the NY landlord tenant statutes for your rights and obligations:

    2 - Get a lawyer to advise you on what to put in your lease.

    I think that you are a bit of a doomsayer when it comes to renting. A good umbrella liability policy is not expensive and covers that kind of problem. I suspect that having the swing set would be a better draw than what the liability policy would cost the OP.

    Again however, that is assuming that the swing set is in good condition. An already rusting out metal one or a wooden one that is rickety are NOT worth leaving there.
