Why does it matter if quid pro quo is difficult to prove in this case? Who do you want to prove it to? Given that the quid pro quo in this case is perfectly legal...

So if the company has been made aware of the issue with their manager, and it keeps on happening and being reported to them, what's the next move?

Can the company really use "we kept on telling him to stop doing that" as a legal defense?
