    Why does it matter if quid pro quo is difficult to prove in this case? Who do you want to prove it to? Given that the quid pro quo in this case is perfectly legal...

    I understand defamation, and there are witnesses for much of this. Also saved text messages.

    So if the company has been made aware of the issue with their manager, and it keeps on happening and being reported to them, what's the next move?

    Can the company really use "we kept on telling him to stop doing that" as a legal defense?

    no, that isn’t a defense

    and the next move is to file a complaint with the eeoc or the California state versaion of the eeoc

    To clarify, EEOC and related claims must be filed by the affected individuals. To reply to your thread's title, the SOL applies to the most recent incident.
