    Default Hard Question: Can You Appeal a Sister-State Judgment

    My question involves court procedures for the state of: CALIFORNIA

    Hey Gang,

    Quick, but hard question for you:

    My client got a judgment against her in Louisiana and the corporation now has filed a sister-state judgment in California.

    I'm filing a Motion to Vacate the judgment.

    If I should lose this judgment, can I appeal? And will this buy more time before they seize her bank account, etc?

    In what state do you practice and in what state are you planning to file the motion to vacate? If by sister state judgment you mean that the judgment creditor domesticated its Louisiana judgment in California, why didn't the client challenge the domestication? And if you plan to move to vacate in California, what grounds do you plan to use to do that?

    Your client could appeal should you lose on the motion, but that may not stay enforcement of the judgment unless a sufficient bond is posted.

    Yes, and I suggest you review Title 13 of Part 2 of the Code of Civil Procedure ("Appeals in Civil Actions"). I also suggest reviewing the Rutter Group's Enforcing Judgments and Debts practice guide. If you don't have a copy in your office or access via Lexis or Westlaw, it is available at any county law library.
