    Default Selling Co-Owned Property

    My question involves real estate located in the State of: NY. What are the best options in selling a co-owned property when the other party refuses to sell?

    Partition might not be the appropriate action if this has to do with the marital home that was the subject of your divorce:

    If I am reading that thread correctly, your divorce decree gave you possession of the home but did not award you ownership. Had you been awarded ownership your ex could have been compelled to sign over the home to you or be held in contempt.

    Please clarify what the decree says.

    At any rate, I think the place to litigate this is back in divorce court which may be less costly than a separate partition lawsuit.

    Talk to your divorce lawyer.
