    Default Collecting Ss Benefits - Can Employer Cut My Pay

    I'm in NJ and collecting SS benefits (full retirement age) while still continuing to work full time. Somehow my employer found out and now wants to cut my pay. When I applied for benefits, SS said my employer would not be informed, so I don't know how this could have happened. Can they actually cut my salary?

    Any advice would be appreciated. TIA.

    As long as you are paid minimum wage, the employer can pay you whatever he wants to pay.

    And you, of course, are free to seek employment elsewhere.

    On the other hand, perhaps you should talk to an attorney and see if there is a possibility of an age discrimination action.

    Or, you can just mention age discrimination to your employer and see if he backs off.

    I'm considering speaking with an attorney. I believe it's illegal to cut an employee's pay based on the fact that they're collecting benefits. Mentioning age discrimination is a good strategy also. Thanks for your reply!

    Actually, age discrimination would likely be your only cause of action and in this case, it is a pretty good one.

    The only way your employer may have gotten a hint from the SSA that you were receiving benefits would have been receiving a verification of earnings request from the SSA. Your employer guessed from that and your age.

    PayrolGuy, when someone is receiving social security retirement and they have reached Full Retirement Age. Their monthly benefits are not affected. Why would SSA request verification of earning ?

    I can't say it never happens, but my husband applied for his benefits a year or so ago, at full retirement age, and they did NOT verify his income.

    There is no way to know if age discrimination is at work here based on the few facts we have. A lot depends on exactly what the reason is for the employer's action. I'd not be willing to say that it's a good (or bad) claim with what little information we have. Certainly the it may be worth consulting an attorney litigates illegal employment discrimination cases to see about that.

    It effects taxability, but the SSA is not concerned with enforcing that.

    I think it effects the cost of Medicare now, maybe that is why? I now see clients with higher overall income paying considerably more for their Medicare.
