    Default Parking in Bus Zone

    My question involves a parking violation from the state of: California. The zone was not marked by a sign saying bus zone, and it was not marked red or for a loading zone. The only sign that was there, was an OmniTrans sign.

    What code section was cited? Was the curb painted with a color?

    Given the reference to OmniTrans, I'm assuming San Bernadino.

    I'm assuming this is the operative part of the ordinance (52.0121):

    (d) Marking of Bus Loading Zones.Bus loading zones shall be indicated by appropriate signs or by a red line stenciled with white letters “No Standing” together with the words “Bus Zone” on the top or side of all curbs within such zones.
    (e) Use of Bus Loading Zone—Restricted. No person shall stop , stand or park any vehicle except a bus in a bus loading zone.


    Absent a marked curb, I would argue "appropriate sings" would have similar verbage rather than just indicating that there is a bus stop there.

    Amusingly this laughable definition appears in the code:

    BUS LOADING ZONE. That space adjacent to a curb or edge of a roadway reserved for the exclusive use of busses during the loading or unloading of passengers.



    So, it appears that BUS LOADING ZONES don't have anything to do with a bus, rather the public display of affection by the passengers.

    This is why I was asking for the code section. Sometimes what people think the offense is for is NOT what it was really for. If written by hand, not an automated cite system, the verbage can be anything and may not entirely match the actual offense.
