    Default Security Deposit and Liability for Rent

    MY BROTHERS LANDLORD OPTED FOR A TERMINATION OF LEASE , AT THE END OF A LEASING PERIOD. HE HAD LIVED THERE FOR 6 YEARS AND SHE DECIDED AT THE LAST MONTH, HE WASN'T ALLOWED TO HAVE PETS ANYMORE. HE DIDN'T WANT TO GIVE THEM UP, SO SHE TERMINATED LEASE AS SHE HAD NO REASON TO EVICT.

    IN THE TERMINATION LETTER, SHE STATED HE HAD TO LEAVE ON OR BEFORE JUNE 30,2005. HE LEFT ON MAY 31, SENDING HER THE INFORMATION CERTIFIED ON WHERE TO SEND HIS SECURITY DEPOSIT. SHE NOW SENT HIM A LETTER THAT HE OWES FOR THE MONTH OF JUNE RENT AND ALSO TO REPORCELINE HER TUB. THIS TUB IS 50 YEARS OLD AND IF THERE ARE ANY CHIPS IN IT, IT;S BECAUSE ITS OLD.

    IS HE LIABLE FOR THE MONTH OF JUNE RENT. HE DIDN'T LIVE THERE AND HER TERMINATION LETTER STATED HE HAD TO LEAVE ON OR BEFORE JUNE 30, IT DIDN'T STATE HE HAD TO PAY FOR ALL OF THAT.

    ANY INFORMATION WOULD BE HELPFUL.

    when was the lease supposed to end ?

    The lease was supposed to end on May 31, 2005.

    She gave 60 days notice to terminate and vacate on May 1, 2005.

    I don't see how she can charge him for June rent if the lease ended May 31st and he was gone before June 1st. that just seems fishy.

    what state is it in?

    He is in the state of Pennsylvania.

    Her issue is that because she gave 60 days notice he had to stay the 60 days...Her letter stated she was giving 60 days notice, but he could leave on or before June 30. We figured if he gave 60 days notice, he would be liable for the June rent, but since she gave the 60 days and stated he could leave on or before June 30, then he could leave before and was not accountable for the June rent.

    Did the lease require him to give notice if he was not going to renew at its conclusion? If so, how much notice did it require?

    He signed a lease 3 years ago...it states if either parties wishes to terminate the lease after the initial year, they must give 60 days notice....

    That would seem to be the problem - he didn't give proper notice in order to move out prior to the date set by the landlord.

    But her notice stated he was requested to leave on or "before" June 30, if you leave " before" are you required to pay ?

    Also, since she already gave notice, why would he have to give notice again ?
