    You have to look at all the sections of the statute and not just any one section (in this case sections 47-50).

    In the example you are using (2 days off in 12 worked) you are using the same day off to finish the 12 days as the first day off to start the next 12 days of work.

    For your example to work you would have to have two days off in a row.

    And I did say that some employment categories are not subject to the law.

    week 1 the last three days for brevity

    Thursday, Friday, SATURDAY

    week two

    SUNDAY, Monday, Tuesday, Wednesday, Thursday, Friday, Saturday

    week three

    Sunday, Monday, Tuesday, Wednesday, Thursday, Friday, SATURDAY


    week 4

    SUNDAY, Monday Tuesday......

    all cap days are days off


    Since the op is working only one weekend in a row, this allows for two days off consecutively with no more than 6 days in a week without a day off.


    And,since the Saturday of week 3 is within the six days next from a working Sunday, it complies with section 47 regardless of whether is must or not.

    No. You argued the worker would have to have two days of in a row and given you were disputing the legality of the schedule, it’s reasonable to presume you didn’t change your positions and now acknowledge you were wrong in your initial statement.

    If you want to us the 12 day example, the employee would have to two days off in a row. Do you dispute that considering you said that the employee would have 2 days off in a row?

    What are you even talking about. I spelled it out for you.

    Either you were incorrect in your assumption or not:


    I don't understand your analysis. How is it possible to comply with the 1 day off in seven when the employee has to work 12 days in a row.
