    Default Can You Use Your Home Address as a LLC Mailing Address

    My question involves business law in the state of: California

    Hello
    We are going to form an LLC because we want to purchase a rental/income commercial property and want this commercial property to be titled under the LLC.
    Can I use my home as the mailing address for the LLC?
    Since I will not be occupying the commercial property, I did not want the Grant Deed and other mail arriving at the commercial property.

    In addition to having a mailing address (which can not be a PO BOX), you are required is to have an "agent for service of process" (or what is commonly referred to in other states, a registered agent). The agent must be a person who resides in California or business able to conduct business in California, with a REAL street address in California (no PO boxes) and is open during normal business hours to accept any legal service. You could use yourself and your home address, but you'd better make sure that you are regularly available.

    From a business perspective there is nothing wrong with using your residential address for your LLC. However, you had better check your jurisdiction's zoning ordinances before you move forward. Using your residential address to conduct business can be prohibited by zoning laws.

    You will likely need a business license in your county to conduct business at that address. If the zoning says that you can't operate a business in a residential zone you will run into problems getting your business license and other problems will surface as well.

    I am sorry Bud, but you are completely wrong on this issue. A mailing address has nothing to do with whether or not business is conducted at that address.

    No LL I'm not incorrect. Zoning laws prohibit running a business from a residence regardless if it is only an address or a place of business with manufacturing, warehousing, sales, or offices.

    This OP had better check his zoning laws.

    No, its not. Once again, a mailing address is irrelevant to an operating address.

    Let me put it this way: I have lived in a number of different cities and counties and in none of them was it prohibited for someone living in a residential zone to receive business mail there. The whole purpose of zoning is to restrict the use of the property to certain activities. Getting mail for a business at a home does not change at all that is is still just a residence and that no business activity that impacts the neighbors takes place there. Since you are the one making the assertion that getting mail alone might violate the zoning law, can you provide a citation to any zoning ordinance that says that?
