My son & I would like to buy 3 homes together. One he will live in, another I will live in, and the third will be rented. Possibly there may be others in the future.
My question is how to title them so if one of us passes on the other gets it without probate. We also want to be sure the two homes we occupy get homestead, which is a very important tax saving tool in Florida. We want to know if a trust or foundation can be set up. Will this protect us from a spouse trying to take a share of the homes? I am married, but haven't lived with my spouse in several years. I do not want him to claim a share of any of these homes. He does not give me support money and we do not have anything to do with each other's lives.
How can we deed these properties to protect them from my spouse, and still allow the properties to pass free and clear, without the added court expense of probate, to my son or I as survivor? Please explain what trusts and foundations are and if they will help us.
