    Question No Job, What Happens With Child Support

    Briefly:My ex bf was given the amount of CS that he has to pay including the amt for the arrears (18months, No cs). He raised hell the day he found out how much he may have to pay. My attorney explained to him that this was non-negotiable, he still doesnt get that it is based on income. Now all of a sudden he is saying he doesnt have a job anymore, I have feeling he quit! What happens now when this is court ordered? How can he pay?

    If he doesn't pay, he will get to visit the other big boys in the clink.

    If he doesn't have a job he can petition the court for a modification of support. The court will not necessarily grant modification, particularly if the period of unemployment is deemed voluntary in nature. If he doesn't ask for modification he will continue to be required to pay the amount defined in the present support order.

    Here in Texas, the court can set child support on earning capacity, not just on what a person actually earns. So quitting would not help him here.

    How is OP supporting himself? whatever he is using for income can be used to pay said support. If OP was still living with spouse and children he would have to continue to feed them! A simple modification seems in order here but to not pay any support is silly
