I need to know the statute of Limitation of Insurance Fraud in SC. I have lived her most of my life. At age 28 I lost my husband to a tragic accident, this was 16 years ago. And just August 2006 I lost my son to a simular car accident. But this time there were alot of things I just discovered. His grandmother, on his father side, requested for me to get her a death certificate. Due to the timing of my son's death and her asking, I just walked away. Now, I have discovered that she had 3 life insurance policies on him. She contacted me due to a letter in my name came to her home. I got the letter in which it was her insurance (United Ins) company sending their condolence for the lost of my son. But they states that I submitted an incomplete claim form, I never completed anything. I was not even aware of this form. I contact the customer service department, and discovered that the insurance was taken out by my decease husband, and the policy and beneficiaries has been changed prior to his death. I request to get a copy of everything they had with my name on it. She faxed me copies of the beneficiary change form, application & the claim form in which all had my name and someone signed my signature. At this point it is clearly insurance fraud and forgery that has happen. I contacted the insurance company and made them aware of this, also took they a copy of my actual signature as well. But now they are saying that the grandmother is their client and it has been 16 years since this has been done, it is nothing they can do. This is very distrubing- due to this is a crime. I have just discover this crime against me, it seems like no one is doing anything.I know that there is a discovery exclusion in this statute of limitation. Please help me. I have contacted the Attorney General and the local police for the forgery and insurance fraud. But they are telling me they are not sure due to the time if anything can be done. She has gotten away before with big $$$$, and they are allowing her to get away with it again. Please advise me of the law in this case.
