    Default Does There Have to be a Father Listed on a Birth Certificate

    My name is Missy I live in Ohio. I have been married for 12 years. We have been separated for 3 years now. We have very little contact. I have been seeing another man for the better part of those 3 years. I am about to have this mans child in 1mth. My question to you is what name, if any, will I have to put on the birth certificate?

    Well since you are married, it's presumed that it's your husband's baby until you can prove differently...

    Yes, I kinda knew that from talking to people and reading, but I want to know if I have to put a father on the birth certificate. Can it not just be left blank?

    Ohio law is pretty clear:
    Quote Quoting Ohio Code § 3705.09 - Filing and registration of birth certificate.
    (F)(1) If the mother of a child was married at the time of either conception or birth or between conception and birth, the child shall be registered in the surname designated by the mother, and the name of the husband shall be entered on the certificate as the father of the child. The presumption of paternity shall be in accordance with section 3111.03 of the Revised Code.

    Ok. Now. I just have to have a paternity test with my child and my ex, even though he is not the father, just to prove he is not the father. Ok. I get that. Now since he has to be on the birth certificate how do I get his name removed?

    I just want to know the steps I need to take before this all happens.

    You would establish your boyfriend's paternity then seek amendment of the birth certificate. I'm assuming your husband won't object.
