    Default South Dakota Townhouse Dispute Between Neighbors

    I live in one of 8 townhouses. They are split into groups of four with a lawn between the two groups. I live in the townhouse at one end and own half the split lawn. There is no homeowner's association. There were rules however that I agreed to, and everyone did as far as I know, when I bought the townhouse.

    One rule is that the concrete pad on the split lawn, on both mine and my neighbor's lawn, is to be used for garbage pickup for all 8 townhouses. 6 1/2 years ago all townhouse owners decided to not do that anymore and hire their own trash pickup off their own driveways.

    For the past two years there has been a dispute over the ownership of that concrete pad. I think the half on my land is mine to do with as I please and have kept my garbage cans on it. The other neighbor and the two neighbors next to her, all parents of 2 year olds, think it's community property and let their kids play on it, walk on my newly planted grass, play on my driveway, etc. I have talked to them before and they all disagree and say that in the rules it's community property.

    But there are other rules and they are not following them such as you cannot paint your fence, add anything to the outside of the house unless everyone agrees and everyone does it at the same time. They have broken all the rules and I didn't care. But I care about the concrete pad as I don't want them on it.

    Why? Because two years ago when my 10 year old daughter walked on one of their driveways the woman threatened to call the police on her for tresspassing. The only way for her to get behind the townhouses to go to her friends house on the block behind us is to walk across the driveways and go behind them due to a fence we all share and a new fence put up on against one side of the townhouses. So if my daughter can't walk on their driveway (no sidewalk, extremely busy street we're on) then they can't play on my property.

    The three mothers let their kids run all over and were on my new grass tonight so I nicely told them to get off the grass. I overheard one mother (never spoke to her) tell her son later to get off the grass or the wicked witch of the west would come out.

    Is half the concrete pad mine and how do I get them to look after their kids and keep them off my property?

    If there's no homeowner's association, and no association rules or similar rules, you're going to need to check the title history and, if applicable, subdivision plat to see who has rights to that concrete platform. You may wish to get help from a real estate lawyer, although you can do this yourself, because although you will be charged you will save a lot of time and will get a more reliable answer.
