    Default Parental Kidnapping

    I'm just curious. My wife moved to FL and filed for divorce (separated in VA a yr ago). I knew where she and my son moved to, and we both agreed that I would have him part of the time and so would she. I was supposed to have gotten him back in June, but now I find that she moved and will NOT tell me where. There are no court orders saying that either one of us have any more or less rights than the other parent. She tells me that if I come looking for my son, she will get a restraining order. She's gone nuts. I have NEVER pushed, slapped, or abused her in any way shape or form. She just didn't like what I had to say when I told her I wanted out.

    I just want to know could that be considered kidnapping (of my son) because she will not tell me where my son is living now and refuses to give me any visitation with him? As I said earlier, I still have the same rights to my son as she does. I just want to be with my son.

    Default Mother Hiding With Child

    Is the divorce now complete, with a custody order in effect?

    If so, typically, the mother will have been ordered to keep the court appraised at all times of her address. Also, she would be obligated to cooperate with the parenting time arrangement.

    Rather than trying to find her, consult a family lawyer in the county where the judgment was issued about the possibility of getting an order compelling her to appear in court and explain why she is failing to abide by the court's orders.

    I am not familiar with Ohio law but in Arizona it is kidnapping to take a child and not tell the non custodial parent where the child is
