    Question Can You Receive Survivor's Benefits and Disability Benefits

    My question involves a person located in the state of:new york
    i have just received widows survivors benefits spouse deceased husband who worked longer then i did my parents estate was settled resently question previously being on ssi disability benefits and now i'm on the above mentioned will this effect my benefits and are ssi and widows benefits the same or a different resource from the govenment

    Widows benefits will not be impacted by an inheritance.

    If you are receiving SSI (Not SSDI), then the assets you receive through an inheritance could render you ineligible for SSI benefits, but they won't affect your survivor's benefits.

    The money comes from different funds.

    Itís true that as a widow, you can normally collect survivors benefits based on your spouseís earning record with Social Security once you turn 60. However, if youíre disabled, you can collect survivors benefits earlier. These benefits are called disabled widow(er)'s benefits (DWB). The deceased spouse must have worked enough years paying Social Security taxes into the system for the widow or widower to be eligible for Social Security benefits.

    You can't draw from more than one SSDI/survivor/retirement benefits. You take your pick of the survivor benefit (including as George states the DWB may allow you to pull based on your husband's earnings early) or what you would qualify on your own. Generally, you'd take whichever was higher. However, one trick is that you can pull benefits based on your spouse until you reach the full retirement age, so that when you start pulling benefits based on your own earnings, you get a higher amount for not starting earlier.

    As pointed out SSI is a different beast and need based. If you're pulling benefits from elsewhere for any reason, you probably won't qualify. It's pretty straightforward, your inclome from other sources (including SSDI or survivor) less some exclusions will reduce your SSI benefit. If you reduce it to zero, you don't get any SSI payment.

    My son was 17 when my husband died. He received social security payments from his father’s account, and when he turned 18, he began receiving disability payments from social security (he is disabled). These also came from his father’s account as he could not perform “meaningful” work according to the rules. He still receives payments today over 20 years later as he is permanently disabled, and they come from his father’s account.

    All of the different benefits come from the same source, and that is the Social Security Administration. However, you do not have to be disabled to qualify for widow's benefits or regular retirement benefits therefore anything you inherit from your parents will not impact your widow's benefits.

    Your widows benefits won't be affected by SSI. however if you are receiving SSI before survivors benefits then they can be affected by the same. For more information you have to call directly to SSA on: 1-800-772-1213.
