    Question Last Name Wars

    Hi I live in Fl. I have a son who is 18 months old. When he was born me and his father were no longer together and I never told him I was pregnant, I gave my son my maiden-exhusbands last name which has been my legal name for the past 7 years. Paternity test has been done and the father will be added to the birth certificate, and he also filed a motion to change the last name but I do not wish to change my sons last name. Because I did not agree to change the last name he hasnt seen the baby in 12 months neither has he helped me with any support money. My question is am I going to have to change the last name? Ive read that if we were never married I have the right to name the child. What is it that the judges see as best interest for a child when it comes to last name. All i read is about things that have nothing to do with a name. Confused!!

    If there was no child support order in place, he was not obligated to send support. Quite honestly, legally he was not the father of the child until now.

    A judge may order that the name be changed with the child being so young, it is honestly just up to the judge that you get.
