    Default What Medical Expert Will a Malpractice Use for Records Review

    My question involves malpractice in the state of: AZ

    Hello, when a malpractice attorney sends records to an expert to review records, would this medical expert be an expert in the concerned specialty. For example if the injured person sustained injury by a ENT doctor would the expert be a ENT specialist or can he/she be from any field and calls himself/herself an ' expert'.

    I am asking this because I realized today that the attorney with whom I was working with had sent out my records to a Cardiologist for ' expert review', though my issue has anything to do with a Cardiologist. I find this ridiculous

    The expert is a person that the lawyer or his firm works with to review the files. An MD is an MD. The cardiologist while not an ENT is likely skilled in reviewing records for malpractice cases.

    In terms of an initial review, many law firms will use a professional other than a doctor for an initial impression, then go to additional professionals as needed. If they have a cardiologist who will give an assessment for considerably less than it will cost to obtain a review from specialist in the same field of medicine as the doctor who allegedly responsible for the injury, then it may make sense to have that doctor assess the case before spending $thousands more for a review by the other specialist.

    Does your use of the past tense mean you're no longer working with this attorney?

    When you called the attorney and asked why he sent the file to a cardiologist for review, what response did you receive?
