    Default How to Address Conflicting Transcripts if Recordings of a Court Session are Lost

    My question involves criminal records for the state of: Alabama

    Who is the trial judge who ordered another court reporter to transcribe from the apparent sole audio recording of the capitol murder/death penalty case of Tawuan Townes?

    What are the court reporters names and is it true this is the second time this same trial judge had an audio recording retranscribed?

    If it is true this happened before, did the audio recording get lost the prior time?

    It is hard to imagine in the United States our Supreme Court does not initiate Habeas Review and issue a mandate speaking to what seems beyond merely outrageous; especially since none involved with the highly irresponsible handling of the supposed only easily-duplicated and easily-stored-safely audio recording are being held accountable.


    Well that and the media sure seems to have a black-out on disclosing the names of all involved, including the trial judge.

    This means this could happen over and over and over again.

    Not hard at all when you consider that the Supreme Court in most matters has appellate review jurisdiction only; it cannot on its own initiate a habeas corpus action.

    And, of course, there is the issue of whether in fact your view of things is the correct one.

    the circumstances and facts surrounding this leave even the judge (who has disgraced the judiciary) and at least one of the court reporter in a position no honorable person should ever have to answer for and no person not deranged or tragically defective should ever advocate for, even for money

    I read what Sotomayer wrote and the system is badly broken when this outcome can stand with no remedy available

    There would be no excuse even if this happened only once but, this was the second time by the same judge

    That all being said, the name of the judge and the two court reporters should be all over the internet requiring no extraordinary efforts to find

    This assjack sounds like a few that sadly remain wasting oxygen in other states

    I still haven't found the names of the court reporters and the facts surrounding the first time Judge Larry Anderson did the same thing are sparse and not to be found in plain view.

    Townes should get a new trial before a competent judge that has no record of such highly improbable antics which very much appear calculated solely to conceal his error with a complicit court reporter who no doubt has quasi-judicial immunity

    Our courts are supposed to be open and there is no excuse for them to be live-streamed and broadcast for all to see and hear.

    I understand certain trials have circumstances which should preclude them from being broadcast but, those are narrow exceptions.

    There is no logical and rational excuse to justify anything like this ever happening during any criminal proceeding in America, not even for non-serious charges like petty rape, killing somebody that needed it or even 1st degree jaywalking.

    You would investigate the names of the judges involved and what they ordered by reviewing the court file. You will find court reporters identified on the transcripts they prepare and on the certificates filed with the court. If there have been court hearings over lost recordings, you will find out what happened by reviewing transcripts of those proceedings.

    The article you link does not speak of multiple transcripts. If a certified transcript is alleged to include an error that weighs in favor of the defense, and there is no recording to demonstrate that the transcript is wrong, the appellate court can be reasonably expected to go with the transcript.
