    Default When Can a Landlord Charge Back Rent

    My question involves landlord-tenant law in the State of: Pennsylvania.

    Is it legal to allow landlords to charge back rent on top of first months rent plus an escrow? This back rent goes to the real estate
    listing the rental as a commission. I believe this should be a business expense that should be absorbed by the landlord. If I pay this
    back rent, then I am paying for his business expenses to advertise his property.

    You are correct. The landlord is trying to get you to absorb a cost that is part of his business expense. However, he could just as easily up the rent on a monthly basis to cover that cost as well. I don't believe that there is anything specifically illegal about what he is doing. Its just a silly practice on his part rather than just raising the rent.


    You can always refuse to rent from him if you have to pay "back rent".

    It appears to be the same practice by all landlords in the Pocono area of Pennsylvania. I would prefer to rent a house then an apartment. But I will be moving from the Pocono's back
    to Levittown, Pa. and I believe these practices will follow me. So If I cannot bargain with the landlord of a house rental, then I will choose an apartment.
