Although you didn't say who "he" is, anyone can sue anyone for anything (although Ohio law requires that a wrongful death suit be brought by the personal representative of the decedent's estate for the benefit of the surviving spouse, children, etc.).

Were you financially dependent on your mother? Did the killer have significant assets such that a wrongful death suit against his estate would be worthwhile?
