    Default Evicting Family Members

    My question involves landlord-tenant law in the State of: PA

    Long story short, I own the house that my mother and adult sister live in. Neither pay rent. My sister allowed another person to live in the house without my permission or approval, as the owner (he has been there for 3 months). I would like to evict my sister and this other person. Just file paperwork and be done? What other issues will I run into or have to address? Thanks.

    Even though they don't pay rent, a court may still regard them as your tenants and as such, require that you give them whatever notice period your state requires (most often 30 days) for a tenant to move out. This must be done in writing. If they do not move out within that notice period, then you can file for eviction.

    However, what if your mother doesn't want to live alone? What if this causes a hardship for her? Do you want your sister and the other person out simply because your sister didn't get your permission, or is there something more to it?

    Me and my sister grew up in this house with my parents. My grandparents built the house and paid for it, letting my parents live there rent free. 30 years later, my sister and mother are still in the house. My sister is an addict. She has random people comong over all of the time at all hours. She is also on probation. Additionally, I am afraid to even allow my two young children to visit, due to the potential that drugs/needles are present.

    Perhaps there is a better solution? Requiring rent? There is no formal lease or contract or anything. My sister and her live-in friend are freeloaders and take my moms car constantly without her permission. Finally, I live 100 yards from my mom so can easily help her.

    Well, then the eviction route looks like your best bet. However what will you do if your mother lets her back in? Mom lets her get away with taking her car without permission, I don't know that your mother will be strong enough not to let her back in.

    Can mom do that? Mom doesn't own the house or pay rent. Can she legally allow her back in? I agree, my mom is constantly manipulated by my sister and taken advantage of, and she will not put her foot down.

    Legally of course she cannot do that. However, a lot of parents couldn't say no to a child who is begging because they have no place to go. What are you going to do if she does? Would you actually evict your mother from the home she has lived in for 30 years?

    No, I wouldn't evict my mother. So sounds like there is no good solution. I've got a house that just costs me money, with no income. And 2 deadbeats taking advantage of my mom. Who I cant evict, because weak mother will let her back in. ...guess this is no longer a legal question haha.

    What would you all do??

    Evict doper sister and friend. Put Mom in an assisted living place where other occupants are not allowed and visitors are limited.

    Then sell the house and the car.

    That is not a bad idea if assisted living is appropriate for mom. We don't actually know how old mom is.

    I would wait for my sister to have plenty of drugs around before notifying the police and telling them that they have YOUR permission to enter the dwelling. She would be in violation of her probation as well as any new charges that are brought. That should keep your sister out of the house for awhile.
