    Default Retail Fraud at Meijer

    I went to Meijer with my two friends without knowing they were both planning on shoplifting. However, later on they told me, and they concealed items in their bags, after ripping open packages and leaving them hidden around the store. I bought 3 drinks, and then we left, no alarms went off, and a man stopped us, showed us his badge, and had us follow him to the back. He told us he followed us throughout the whole time we were in the store.

    From there, the detective asked us to sit down, and he went through the contents of my friends' bags. I did not personally have anything stolen on me. He said he wasn't going to call the police on us if we complied with him, so we did. They both emptied their pockets, and put everything on the table. He called our parents, and soon thereafter, the police showed up. We were all told we were being arrested, read our rights, and then the police asked if we had anything to tell him. My friends told me to talk to him since I didn't do anything wrong, so I did.

    I told him that I didn't know they were going to shoplift when we walked into the store. My friend recently became a waitress a few weeks ago, and i thought she was intending on buying everything. I put a few things into the cart I thought she was going to end up paying for. I never opened or ripped open any packaging, nor put anything into either of my friends' bags.

    The detective then told the police that he saw me open packaging, and that he saw me put things into my friends' bags, which isn't true.

    Is what he did legal?

    I got arrested before I ever got a detention before..is there a chance I will get off without any charges?

    The letter I received says "Pay to us civil damages in an amount equal to 10 times the retail price...equaling a total of $200. If you return any uncovered property and pay the amounts indicated above to us within 30 days after the date this notice was mailed, we will not take any further civil action against you.
    You are not required to respond to this demand if you believe that you or your minor child are not guilty of committing retail fraud or if you choose not to respond. If you fail to comply with this demand, we will be authorized by state law to bring a civil action against you to determine your legal responsibility for the return of any unrecovered property and the payment of the amounts indicated above plus the cost of the action, including resonable attorney fees. These civil proceedings do not prevent criminal prosecution for the alleged retail fraud."

    What does that last sentence mean? Who can still prosecute me? Does paying the $200 make me have to plead guilty if there is a trial?

    I am a 16 year old girl living in michigan, if that helps answer these.

    It means they have until SOL runs out to press charges but if you pay Civil Demand that not likely to happen

    most state laws are if you are even in a store with someone you know who shoplifts then you can also be charged. To me it sounds like you had an idea of what they were doing and there is not really any way you did not know. I am not saying you helped but in most states that does not matter.
