    Question Can I Get My Holding Deposit Back if Terms of Lease Weren't Agreed to

    My question involves landlord-tenant law in the State of: California

    I recently signed a Deposit with offer to rent or lease for a lease take over for an apartment in Long Beach. The application asked if I had pets and asked for breed etc. I filled out that information accurately and was approved to rent the unit. When i reviewed the lease, there were terms regarding additional pet deposits and pet rent. When I asked the leasing agent about it she wasn't aware that I had pets. I told her that I filled that information out when I applied. She then told me that pets were allowed, but that I would need to pay an additional $300 deposit for each pet, and $75 a month pet rent for each pet. I told her that I couldn't agree to those terms and had I known of those requirements, I wouldn't have signed the deposit and offer to rent agreement or paid the deposit. Those requirements changed the financial terms of the agreement significantly.

    Can i back out of renting the apartment and get my deposit back since the terms of the lease are unacceptable to me and I wasn't aware of them when i paid the deposit?

    I am supposed to go sign the lease and pay the first month's rent tomorrow.

    1 - Can't answer that without knowing what the terms of the deposit agreement was. You'll need to quote it in its entirety word for word.

    2 - Common sense dictates that you should have asked for, and read, the lease form before handing over any money.
