    Default Shoplifting Help in California

    Hi, I am a 17 year old from California and had some questions I would like to be answered. So I was caught shoplifting and no police were called and I received the civil demand as I read in these forums. The LP said I had two years before I was free from the risk of being sent to jail, I was wondering if this was true because I believe it is against th ex post facto law(something like that) to be charged for a previous crime that occured in the past. The LP said if my mom or brother wanted to they could call him and I would be arrested for shoplifting even though it happened months ago. I did sign papers saying I wasn't supposed to go back for six months and if I did I would be trespassing and get arrested I understand that. Also I was wondering if this would show up on a background check if I applied for a new job. The LP said it was a misdemeanor(I have a clean record) and if I did it again it would be a felony?? Is this true, I am not going to do this again. I just think a lot that was said wasn't true and just a scare tactic. Thanks for your help, I appreciate it.

    Until the SOL runs out you can still be charges and I believe that is two years!

    Hey, I was also wondering, how would I know if I was charged with anything. I have read a few other posts and it said if there weren't any cops than they were not charged with anything. The LP said I was charged with a misdemeanor is that true if no cops were involved? And if I pay my fine is it done with?

    As was indicated above, you can be charged until the statute of limitations runs on the offense you committed.

    So I don't have to put I have committed a misdemeanor on a job application then? Unless I am charged. What does SOL mean?

    No you don't because you have not been convicted yet. SOL means statute of limitations

    but most civil demands give your name to credit reporting agencys that alot of compnies use for background checks. so it is very possiable that this can show up on certain background checks
