    There is another approach. You could try to file a claim directly with the Casino's insurance company.

    I filed my letter of claim with the hotel's corporate office now that the bites have healed. I emailed the letter just yesterday, and the manager of the hotel telephoned me this afternoon. Very nice and polite, he said he could offer me the amount of the actual medical treatment and prescriptions, and the amount it cost to clean/fumigate clothes and luggage. They NEVER compensate anyone for anything but that. I told him that with all I had endured, and lost, due to these injuries, I could not accept the offer. He said he would forward my claim over to Risk Management, and most likely get a letter of response within 10 days, reiterating the same offer. He said they had been to court many times, and never paid anything over the claimant's actual incurred expenses. I told him I would await the response from Risk Management. He added that he was in no way discouraging me from pursuing my claim. So, once I get that response, I would imagine they will be expecting me to hire an attorney and file suit. Anyone have any ideas on that? If they have been to court many times for this same issue it seems they could have found a way to examine each room before a new guest checks in to ascertain it is free of these pests. I did research, and there are several products/tools to do just that. So, if someone brings them into the room, before the next guest arrives, this method could be utilized...and if infestation exists, move the new guests to another room. He stated bed bugs have been a continual problem for over 20 years. Am I expecting too much for such precautions be undertaken? I would appreciate some input - just what any of you may think at this point. Once again, I thank you for your time.

    Unfortunately, it appears they are taking a hard line on what they intend to pay. What are you asking for above your actual damages? If you are willing to work with them on that, you might get some traction. It's unlikely but you can certainly try. If they continue to hold the line, then an attorney and court are the next step.

    Checking for bed bugs in every single room as it is turned over every time it is turned over is likely not to be part of their standard procedure. They may check them on a particular schedule to establish bed bugs aren't there, at which point they can claim "We didn't know about it. It didn't come from us, it must have been one of the last X number of guests." You then get to prove in court that their procedures are inadequate such that they knew, or should have known, about the bed bugs.

    Thank you so very much for the input. At the end of our phone call....he told me to let him know when I came back to Vegas....he would make sure I got upgraded, etc. Thought this was a bit strange.

    It's called trying to win you back as a customer using the tools he has. Comps and upgrades cost them next to nothing compared to potential bad word of mouth.

    Just wanted to tell you adjusterjack - I emailed the claim letter one day to the corporate offices, and the very next day I got a phone call. So, thank you for the advice...it was right on.

    Kind of figured that. Just a tad bit against staying there -gun-shy I guess you could call it. I had such a horrible reaction to the bites....just thinking about it all makes me cringe - big time!!!

    I heard back from the general manager of the hotel/casino today. The legal dept offered me only reimbursement for my expenses. Nothing else. He told me they have never paid anyone anything for this...went to court one time and the injured parties received nothing. He also stated that their legal staff does not want to set precedent...that if they pay me anything above expenses they would have to pay everyone the same way. He told me to think about it for a few days...but that the legal staff would get me a letter of denial. I was not asking for that much. Does anyone know if there has never been any pain and suffering or loss of anything due to bug bites in the history of bug bites? That is what he is leading me to believe. He says they proved they are not able to control it any more than they do already...that is why they never lost a case. Or the one and only case they went to court over. He added in some free nights at the hotel. It's as if unsuspecting guests go there and take their chances with getting bitten by these bugs....and they get off totally even know they know there is a huge problem with them. This seems wrong to me. Any ideas on what I should do?

    You can accept their offer or start looking for an attorney to take them on in court. They are offering to cover your expenses, which is generous of them since their liability has not been established especially if they are now offering cash versus comps.

    While I'm sure someone, sometime in history was able to establish losses/pain & sufffering/etc.. above expenses; it would take a lot of legal research to locate it. It would also require a fact set far more egregious than yours appears to be.

    If you hire an attorney there is a 97% chance that you will NOT "take them on in court." What WILL happen is they will no longer talk to you like a fool.

    What they are doing now is testing your fiber...which appears is saving them tens of thousands of dollars. ...How generous of YOU!

    Chucky, do you have a cite for bedbug cases where hotel guests were awarded "tens of thousands of dollars"?
