Could I conceive of a situation in which it might happen and be proper, depending upon the full facts and department regulations? Yes, I can. But whether or not it is proper in a specific case would depend upon a lot of facts not known to us.
And the fact that the officer was off duty, would not be high up on the list of facts we would need to know.
