    Default Re-Qualifying for Childhood Disability Benefit (CDB) After Loss Due to Marriage

    A disabled child continuously received CDB from age 17 to 40 on his fathers account. Child got married at age 40 and lost his CDB. Child got divorced after six years. Child has never worked because of his lifelong disability. Can the child (disabled at age 17) now receive CDB on his retired mother's account?

    As is explained here, for a marriage to not terminate the right to CDB benefits the marriage must be annulled or declared void. There may be a possibility of gaining benefits through the other parent's earning record:
    Quote Quoting Effect of Divorce on CDP
    A marriage that ended by death or divorce precludes re-entitlement on the same parent’s earnings record. However, a child whose marriage precludes re-entitlement on the same parent’s earnings record may establish initial entitlement on their other parent’s earnings record provided the child meets the requirements in RS 00203.001A.1, including being unmarried. For information on when a child who has been married may be considered unmarried for initial entitlement, see RS 00203.020A.1.

    Are you talking about SSI? Once the person was 18 they should have filed for that on their own.
