    Default Can a Lawsuit Be a Fraudulent Conveyance

    My question involves business law in the state of: New York

    There is an action being brought against a plaintiff business that I suspect may try fraudulent conveyance, is there anything that can be done in advance to prevent this?

    Axon is the defendant, not the plaintiff, in that matter. And what is your involvement in the case? The plaintiff suing Axon is represented by an attorney and if that attorney thinks there is a risk that the defendant may try to dispose or hide assets he ought to know what to do to deal with it. You need more than a some hunch that it will occur, though, to convince a court to act to much more than enter an order preventing the plaintiff from transferring assets during the litigation.

    It is my speculation that the company might try to open operations under a different outfit to avoid any potential penalties. If this is known at this time, could there any steps that might be taken in order to prevent it?

    As Tm stated, that is for the plaintiffs attorney to deal with. They will know what to watch for and what actions can and should be taken
