    Default How Much Money Can I Recover From a Predatory Tow Operator

    My question involves an action in the state of:California.

    My vehicle was illegally towed of a public street by a private towing company. They claimed it was private property. I have photo they provided that proves in was a city street. I want to sue them. How much can I sue them for? I had to pay to get my vehicle back from them. They damaged it I had my insurance repair the damage but I was still out the delectable, not car for two weeks, and a lot of time researching a response to this incident.

    You can sue for what it cost you, the redemption of the car, the cost of the repair deductible (although your insurance Co. may want their money back if you sue for the entire cost of repair), a rental car (if you got one). Forget about your time and inconvenience. But one never knows what a judge might do.

    Them? The towing company and who else?

    Obviously, you can sue for whatever amount you want. The amount for which you should sue is the amount of your damages, and we obviously have no way of knowing that amount. The amount you had to pay to get the car back is recoverable. The cost to repair the damage is recoverable. If you had to rent a car, that would be recoverable. Time spent doing research is not recoverable.

    You can sue for what you're out. No you're not gonna get anything for pain and suffering, emotional distress or for missed work. You could recover punitive damages if you can prove they did it with malice.... such as proving they knew what they were doing was illegal but did it anyways.

    Whether you were a victim of a "predatory tow" or not, I cannot say (based upon the limited info provided). But, here is a link fo some resources on this subject from the state of CA.

    My initial thought is that it is not a "predatory tow" if it was on public property, but it may well have been an unlawful tow and may have been worth reporting to the police.
