    No it wasn't unclear. I stated that this was my ex husband s attorneys. My son never had attorneys. I was told he needed to be signed up for his father's benefits and then I learned about the child support arrears coming out of his back pay.
    It should not be this frustrating and hard to find out about.
    Keep in mind I am not annoyed with anybody here, just the situation in general.
    There has to be a record of this somewhere, it should not be this difficult to find out about it.
    Meantwhile the ex husband still is getting away with after all this time
    It's just not right or fair.

    Many people have specialized attorneys to navigate the complexity of SSDI filings. These would be different from divorce or custody/support attorneys. It is unlikely that his family law attorneys would be receiving payments from SSA for his SSDI. Which attorneys were you referring to?

    Check with your local SS office about your child's benefits. You will need to see who is the representative payee for a minor child; it could be the father. Be sure to take your custody legal paperwork and the child's birth certificate as well as your ID . I do not know what all might be needed so be overprepared. Alternatively, consult a SSDI attorney for advice of what you might need. Prepare to pay for a consultation. You could ask them about what they might so to get the child's backpay, if any, released. My personal experience was that a person is best served by a SSDI specialist rather than DIY for filing for benefits. I recall that the fee was between $%K and $6K out of my back payments.

    (b) Notwithstanding subdivision (a), any person who personally uses an assault weapon, as specified in Section 30510 or 30515, or a machinegun, as defined in Section 16880, in the commission of a felony or attempted felony, shall be punished by an additional and consecutive term of imprisonment in the state prison for 5, 6, or 10 years.
    Does that mean that if someone is just holding an assault rifle while they rob a bank they wouldn't be subject to the enhancement if they didn't shoot the rifle?

    The child support court had to notify SSA he was in arrears. It is possible they failed to do it.

    It sounds like the attorney was stating normal procedure when a dependent is under 18. These checks come directly from SSA. If they do not have any information on it. It appears the money was not deducted from his back pay. Considering the ages of his children. There is nothing SSA can do about it at this point.

    Regarding your disabled sons back pay. If your son receives more in dependents benefits that he did in SSI. SSA will deduct the amount of SSI he received for the month the back pay covers. If any money is left over. SSA,will direct deposit that into your sons account.

    If your ex was not paying child support before your children turned 18. Did you receive your ex's IRS Tax Refunds when he was working ?

    I've pretty much given up on ever seeing these arrears.

    I've told you that I had two children OVER 18

    How many times do I have to say I have contacted the SS office and they refuse to speak to me?

    I called the child support office, the case is closed so they refused to take to me.

    I called Clerk of the court and according to them the debt has not been satisfied.

    Does anyone know if there is a way to find out which department of SS processes these checks? There has to be a record of this someone.

    Please carefully read the post as I have stated everything to the best of the information that I have.

    If child support did not send the information in. SSA does not have it. SSA must have the information from child support . Without it there is nothing they can do.
