    Default What Happens if a Suspended Driver Gets a License in Another State

    My question involves a driver's license issued by the State of: NY

    A license in NY will be revoked in thirty days for six months, due to multiple traffic violations on different occasions. A NY restricted use license was approved. This license had a NY impaired driving infraction (.07) five years ago, paid, settled and closed. This license is up for renewal in eight years. This license now is moving out of state to NJ or PA before revocation takes effect and will stay out of state for the revocation period then come back to NY.

    If the new state issues a license:

    • will the new state be informed by the old state, NY, through NDR of the revocation; if so, then when
    • is any state more beneficial than another
    • can other conflicts come up with DMV / such as new vehicle titling or registrations
    • are there issues with driving in NY (the old state) with the new license from NJ or PA
    • during a NY/NYC traffic stop will, if presenting the new license, will they be able to see the history/revocation of the old license (without providing SS#)

    Your scheme won't work so don't bother with the expense of moving. Stay in NYC where there is plenty of public transportation and you don't need to drive.

    I can almost bet the NDR flag will block you from getting a license in any state.
    You are required to get a license in the state you are residing with.
    Even if you're licensed in another state, your driving privileges can be revoked in a state.
    Computers are a marvelous thing. Can't vouch for NY cops, but down here in the Carolinas we'd definitely see such things on traffic stops. I see all any licenses, revocations, previous histroy, and whether you have a gun permit in none of the states that reports such.

    I put in some slight changes to your text in brackets because licenses do not get infractions and do not move, people do. Moreover, it is important to note that in order to get a driver's license in any state (particularly a REAL ID compliant license) you must be resident in that state and must prove the residency to the state.

    Neither NJ nor PA will give you a license with your NY license being suspended. That information be provided to the NDR and those states will be informed. And as both are members of the DLC, they are obligated to honor the NY suspension and refuse to give you a license for the period of that suspension. Moreover, both states will ask you about revocations/suspensions in other states and if tell the truth they'd not issue the license even if they didn't have the NDR information yet. And if you lie and then they get the NDR information later, you'll lose the license AND might face prosecution for perjury.

    In this situation, no state bordering NY will be helpful to you, so if your plan was to move temporarily to NJ or PA and commute to NY that's not going to work. And if you did have an out of state license and are caught driving in NY, your privilege to drive in NY is still suspended, so when the cop finds that out you'll get cited for the traffic violation plus driving while suspended revoked, which will likely add even more revocation time.

    Rather than going through the trouble and cost of trying get around the revocation in a scheme that is not likely to work, I think you are better off just sucking it up, not driving for the 6 months, and then should you get the license back, start following the traffic laws.
