    Default Return Fraud On A Background Check

    To make a long story short, I was caught returning items at Nordstrom's (in California) without really returning them. I was called in by LP and confessed everything. They asked me to pay for all the items that I had returned and so I did. I signed something that states that I take responsibility for all the items, that I will not go back to any Nordstroms within 2 years and that I am not allowed to work at Nordstroms again. They told me that I might get a call from the police asking me to go to court, but I never got a call or a letter or anything. Since then (which is about 7 months ago) I haven't heard a thing from Nordstrom's or the police. I am looking to apply for a job and I know that a background check will be performed. So my question is, what will show up on my report?

    If there were no Police involved then there is no record. Now anyone can contact your former employer and they "could" say why you left. However there should be no record on any background check since you have yet to be arrested and chanrged!

    panther is right but could be wrong. Did you sign or get a CIVIL DEMAND of some sort? Most of those demands include your name being entered into the esteem database by choicepoint and many companys will use that to see if you have ever been cuaght shoplifting or dishonesty at your old jobs. So it is very possiable they could see this in a background check if your name was givin and they use that database for background checks. NOw on the criminal side you should be fine with background checks.

    Redtoy just told you its a Civil Demand. The state allows a retailer to take "Civil" action againist you. This is a "legal" demand for monies in reference to a theft. Amounts vary but norm is around $250.00 (thats not a gurantee) Its quite possible your name in reference to this Civil Demand will be put in a data base that any possible employer could find if he/she sought it out.

    what papers did they give you? Read them if they gave you any and tell us what they say..

    If someone calls for an employment check all Nordstroms can say is when you were hired, when you left and if you are 're-hire able' or not. Anything else is against the law in Cal.....but it sometimes slips out, like from 'one manager to another' type thing.

    Just a note - that may be Nordstroms policy, but they are not legally restricted to that response. If fact, companies have been sued for not accurately stating why an employee was terminated. For example, an employee is fired from company A for workplace violence. The person goes to work for company B and is hired on the reference check, as stated above. They then commit another act of violence at company B and it is then found out that is why they were terminated at company A. Let the litigation begin!
