    Exclamation Macy's Refund Fraud

    hey i'm eric, i returned from work tonight and my wife, who used to work at macy's, was terminated. According to her she did a return to her credit card with out returning the item. She was soon called into an office with the prevention officer and a witness. She was accused of refund fraud and was told to sign a promise note stating that she will have to pay $2,000 to the store and an admission statement saying the same. She was scared and threaten by the p.o to sign the document. They let her go and told her that a man (most likely police) will contact her via a phone call on monday. I know i don't have many options, it's saturday night and first thing monday morning we are going to see a lawyer. My question is, she says that all the times she has done it, that it does not equal $1,000 and some things the p.o accused her of taking were false. This is her first offense and she is 19. We live in North Dakota.. Help anyone???

    Does this mean she has repeatedly committed this type of fraud but this is the only time she was caught?

    regreting, it seems so, she has done it several times, but not adding to the total of what she is accused of. She was a cashier there and got a taste of easy come so she got crazy with it.

    stick with your plan to see an attorney.

    the relatively small amount that she doesn;t believe she took won't make a lot of difference unless it is a matter of what level of crime she committed. Should she end up with criminal charges, it will more than likely simply be used as a bargaining tool to reduce the charges to the lesser crime.

    It's really hard to argue, "yes, I stole but just not as much as you are accusing me of taking" as a defense in court. In reality it makes the prosecutors job easier since the defense is also an admission of guilt.

    thank you i really appriciate the help, especially this late at night. We will stick with the plan and keep you updated. Am glad she learned her lesson, lets hope we could get out of this one ok.

    i have to ask the cliche, but is there a large chance she will see jail time for this? and if not what could be the most likely outcome? Is there a chance for a diversion, even if we pay the 2 grand by the end of the week?
