    Default Can You Appeal a Divorce in a Foreign Court

    My question involves a child custody case from the State of:

    My ex wife divorced me behind my back to gain full custody of my child. She used unknown address to claim that she couldnt find me and worst used her foreign spouse address as “last known address” to fraudulently divorce me. She never lived there but her spouse.

    I went back to my country and decided to appeal the divorce as because of this I did not get a fair trial and joint custody of my child.

    In my petition I stated that I started the custody process in 2016 and found out in 2018 about the divorce. The divorced was finalized in 2016.

    My child was born before our marriage but we declared him in our marriage as the legal parents.

    She’s currently married to someone else and I presented their marriage of certificate to demonstrate their relationship on using the foreign address. Would this jeopardize the appeal?

    You acknowledged the divorce was legitimate in US courts with all of your shenanigans.

    Good point. But they don’t know that in the Foreign country. They just know that I started a custody petition.

    Even if your divorce was voided in another country it would not be in the US.

    Why not in the usa? If they classify it as invalid it should be invalid in the usa.

    In my appeal I said that I started the custody process in 2016. Would the judge in the foreign country assumed I knew the existence of this divorce? They might assume that a custody cannot be started without a divorce but it could be.

    You have already been told the answer. Your foreign appeal will have no bearing on your US divorce.
